1. Nature of Service

CAB — Case Architect Bharat ("CAB", "we", "us", "our") provides AI-assisted legal document drafting support. CAB is not a law firm, does not practise law, and does not provide legal advice.

Important: All CAB outputs — including but not limited to plaints, written statements, bail applications, counter affidavits, writ petitions, and written arguments — are AI-assisted drafts. They must be independently reviewed and validated by the client's own qualified advocate before filing in any court, tribunal, or regulatory body. CAB's outputs are drafting assistance and not final legal documents ready for filing.

CAB expressly disclaims that its outputs constitute legal advice, legal opinions, or substitute for the independent professional judgment of a qualified advocate.

2. Who We Are

CAB — Case Architect Bharat is an AI-assisted and AI-led legal workflow service operated from Hyderabad, Telangana, India. The service is currently in a trial phase.

3. Eligibility

By using CAB’s services, you represent that you are at least 18 years of age, have the legal capacity to enter into a binding contract under Indian law, and are an advocate, client, or authorized representative with the authority to request, apply, instruct, and upload documents.

4. User Consent & Responsibilities

By submitting a request, you confirm that you have the authority to share all uploaded data, that all documents are accurate, genuine, and lawful, and that you consent to AI-based processing.

4.1 Shared Responsibility

CAB is responsible for the quality of drafting based on the information provided, while you are responsible for ensuring the accuracy and completeness of the information submitted.

4.2 Mandatory - Advocate Verification, Validation and Review.

You agree not to use any outputs without prior validation and review by a qualified advocate. You further acknowledge that the final responsibility for the use, filing, and legal validity of such outputs rests with the advocate reviewing the document.

4.3 Indemnification

You agree to indemnify, defend, and hold harmless CAB and its operators from and against any claims, damages, liabilities, or legal costs arising out of or in connection with any false or fabricated information provided by you, any misuse of CAB’s outputs, or any breach of these Terms.

4.4 Limitation of Liability

To the maximum extent permitted by applicable law, CAB’s total liability for any claim arising out of or in connection with its services shall be limited to the fees paid for the specific service giving rise to such claim. CAB shall not be liable for any indirect, consequential, or incidental damages, any outcomes of legal proceedings, or any losses arising from the use or reliance on its outputs.

4.5 No Warranty (As-Is Clause)

The services are provided on an “as is” and “as available” basis, without warranties of any kind. CAB expressly disclaims all warranties, whether express or implied, including any warranties relating to accuracy, fitness for a particular purpose, and uninterrupted or error-free service.

5. Data Handling and Confidentiality

5.1 Data Usage

Your data is used solely for the purpose of processing your request and will not be sold or shared with any third parties.

5.2 Retention

Your data will be stored for a period of 90 days, after which it will be deleted. You may also request deletion of your data at any time within this 90-day period.

5.3 AI Processing Disclosure

You acknowledge that your documents will be processed using AI systems, including third-party large language model (LLM) providers.

5.4 No AI Training Clause

CAB does not use your data to train, fine-tune, or otherwise improve any AI model, whether operated by CAB or by any third-party provider.

5.5 DPDP Act 2023 Compliance

CAB acts as a Data Fiduciary under applicable law. You have the right to access your data, correct any inaccuracies, request erasure of your data, and withdraw your consent at any time. To exercise these rights, you may contact us at the email address provided below.

6. Pricing and Payment

Pricing is communicated after a review of the scope of work. No upfront payment is required; however, payment must be made prior to final delivery of the completed documents. All fees are non-refundable once delivery has been made. CAB reserves the right to refuse any request without any obligation.

7. Delivery and Revisions

The standard delivery timeline is 5 to 7 business days after confirmation of pricing estimate. The service includes one round of minor revisions. Any major changes, including additional documents or modifications beyond the agreed scope, will be subject to additional charges.

8. Intellectual Property

Upon receipt of full payment, ownership of the final deliverables transfers to you. However, CAB retains all rights, title, and interest in its underlying systems, workflows, templates, and methodologies used in providing the services.

9. Prohibited Use

You agree not to submit any false or fabricated data, not to use any outputs without proper verification, validation, and review by a qualified advocate (as applicable to the party or parties submitting the request), and not to engage in any unlawful or fraudulent activity. CAB reserves the right to immediately terminate its services upon identifying any such violations.

10. Suspension & Termination

CAB reserves the right to suspend or terminate its services in cases of violations of these Terms or misuse of the services. Upon such termination, any ongoing work may be halted, fees may be retained on a proportionate basis for work already completed, and all associated data may be deleted within a reasonable period.

11. Force Majeure

CAB shall not be liable for any delays or failure in performance arising from events beyond its reasonable control, including but not limited to AI provider outages, internet failures, government actions, or natural disasters.

12. Modifications to Terms

CAB reserves the right to update or modify these Terms at any time. Your continued use of the services after such updates constitutes your acceptance of the revised Terms.

13. Dispute Resolution

In the event of any dispute, the parties shall first attempt to resolve the matter through good faith negotiations for a period of 30 days. If the dispute is not resolved within this period, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, to be conducted by a sole arbitrator, with the seat of arbitration at Hyderabad. Subject to the foregoing, the courts at Hyderabad shall only have jurisdiction over the matter.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of India.

16. General Clauses

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Failure by CAB to enforce any provision of these Terms shall not be deemed a waiver of such provision or any future enforcement thereof. These Terms constitute the entire agreement between you and CAB and supersede all prior discussions, communications, or understandings. Nothing in these Terms shall be construed as creating any partnership, agency, or legal representation relationship, and CAB is not a law firm, your agent, or your legal representative. CAB reserves the right to assign or transfer its rights and obligations under these Terms as required.
